Terms and Conditions

 

The following terms and conditions (referred to as "the Agreement") apply to the commissioned illustration services provided by Ana Ribeiro Illustration (referred to as "the Illustrator") to you (referred to as "the Client").

Acceptance
 

The Client isn't required to sign any physical document for these terms and conditions to be valid. When commissioning digital artwork from the Illustrator, the Client is understood to have thoroughly reviewed and accepted these terms and conditions.

 

Services
 

The Illustrator agrees to provide commissioned illustration services as described and agreed upon by both parties.

The services may include, but are not limited to, creating digital illustrations, sketches, and other related deliverables.

 

Price Quotations
 

Charges for services to be provided by the Illustrator are defined in the price quotation that the Client will receive, upon request, via email. Quotations are valid for a period of 20 business days. After the quote expires, the client will have to request for a new one.

The Illustrator reserves the right to alter or refuse to honor a quotation after expiry.

 

Illustration format and delivery
 

The Illustrator only creates art in digital format using the program Krita. 

The finished work will be delivered in three different formats: (.png), (.jpeg), and (.tiff), in the agreed resolution and size.  Other formats can be discussed and agreed upon. 

The finished work and associated files will be delivered to the Client via WeTransfer, using the email provided by the Client.

 

Payments 
 

To initiate the payment process, a non-refundable deposit equivalent to 50% of the total quoted price is required upfront.

The remaining balance, along with any additional costs (if applicable), will be due upon completion of the project. 

Only upon receipt of the final payment will the Illustrator deliver the finished work.

The non-refundable deposit will only be eligible for a refund in the event of cancellation on the part of the Illustrator.

The Illustrator accepts the following payment methods: PayPal, MB WAY and Bank Transfer.

All prices are specified in Euros (€). It is the Client's responsibility to ensure that they have converted currencies based on current exchange rates.

 

Cancellations 
 

In the event of cancellation by the Client, the non-refundable deposit will be retained by the Illustrator.

Alternatively, if the Client prefers, the Illustrator can deliver all work completed thus far, including sketches, research, and partial illustrations. In this case, the Client will be responsible for paying a percentage, determined by the Illustrator, corresponding to the work completed.
 

In the event of communication break on the part of the Client for a period of 30 days (that is, the Client fails to reply to a communication attempt from the Illustrator) the Illustrator will issue a warning email. If this warning email is not replied to (and communication does not resume) within the following period of 30 days, the Illustrator reserves the right to terminate the commission. In this event, all deposits paid will be retained by the Illustrator and the commission will be canceled.

If the Client wishes to continue the commission at a later date they will be required to request a new quote, sign a new quote and pay another non-refundable deposit.

 

In the event of cancellation from the Illustrator, all work completed thus far will be delivered, including sketches and partial illustrations. Additionally, a refund for the amount of the deposit will be provided.

 

Documentation
 

The Client will describe the required illustration as accurately and comprehensively as possible, including specific elements, compositions, colors, and any other relevant details.
 

The Client will specify the purpose and context of the illustration, such as whether it will be used for a scientific article, poster, website, book, or personal use.
 

The Client may provide supplementary materials such as reference photos, technical terms, anatomical information, or examples of similar illustrations that convey the style or elements desired.

In the event that the Client fails to provide adequate documentation and references, the Illustrator reserves the right to charge an additional fee for the time spent on extensive and time-consuming research. This additional fee would cover the hours required by the Illustrator to gather relevant information and develop a clear understanding of the Client's requirements. However, this will be assessed on a case-by-case basis.

 

Sketches and revisions
 

Sketches and images for revision purposes will be sent to the Client's provided email address, with a lower quality and watermarked. 

Up to three sketches and two revisions are included in the agreed upon price, for each requested illustration. Posterior revisions and sketches requested by the Client may be subject to an additional fee.

Revisions can encompass minor changes, such as modifying colors, simple backgrounds, or adjusting the composition.
 

Significant changes to the work after the initial sketch phase, which require redrawing substantial parts of the illustration, may be subject to an additional fee. Examples of such significant changes include adding individuals to the illustration, completely altering the pose, or incorporating a complex background.
 

The Illustrator will not charge an additional fee for changes to errors that are the Illustrator’s responsibility. (Are considered errors all that is described and agreed between the Client and the Illustrator in writing and that the Illustrator may not have respected).
 

Additional fees
 

Research: 5€ per hour.

Sketch: 5€ for each additional sketch.

Revisions: 10€ for each additional revision.

Significant changes: 15€ for each change.

 

Deadlines


An estimated deadline will be provided in the price quotation.
 

The estimated completion deadline provided in the quote is subject to the volume and complexity of ongoing projects at the time of commission. While every effort will be made to meet the projected timeline, the actual deadline may vary. Any changes to the timeline will be communicated promptly, and the client will be kept informed of the progress.

It is important to note that the estimated deadline serves as a guide, and the flexibility to accommodate unforeseen circumstances is appreciated. 

 

The Illustrator commits to deliver the finished work upon reception of the final payment.

 

Confidentiality
 

Any sensitive information shared during the commission process will be treated with the utmost confidentiality. The Illustrator will not disclose or share your information with any third parties without your explicit consent.

 

Governing Law
 

This Agreement shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the Portuguese courts.

 

Copyright and uses of the work
 

The Illustrator holds all copyrights to the commissioned work, as protected by the Portuguese Copyright Law (DL n.º 63/85, de 14 de Março).

Upon completion of the project and full payment, the Client will receive the rights to use the commissioned illustrations limited to the purposes described and agreed upon. However, the Illustrator will retain the right to display the artwork in their portfolio and for self-promotion purposes unless otherwise specified.

If, after the designated period of use (if applicable), the Client wishes to continue using the work, a renewal agreement must be reached with the Illustrator, which will involve appropriate compensation.

Modifications to the work are not permitted without the Illustrator’s explicit authorization.

The work may not be utilized for training artificial intelligence.

Unless otherwise agreed upon by both parties, the work must contain the Illustrator's credit in a visible location.

Any other printed or digital use of the work must be communicated to the Illustrator, and an additional payment may be required.
